Welcome to SecureNeural. Please read these Terms of Service ("Terms", "Terms of Service") carefully before downloading, installing, or using the SecureNeural mobile application (the "Application" or "Service") operated by SecureNeural ("SecureNeural", "us", "we", or "our"), a company registered in Cyprus.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all individuals who download, install, access, or use the Service ("User", "you").

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access or use the Service.

1. The Service

1.1. SecureNeural provides an on-device mobile application that allows users to upload, analyze, and interact with their documents using artificial intelligence (AI) technology.

1.2. Crucially, all document processing, AI analysis, and data storage occur exclusively locally on the User's device. The Application is designed to function entirely offline after the initial download and installation (and any subsequent updates).

1.3. No User documents, content, or data derived therefrom are ever transmitted to, stored on, or accessed by SecureNeural's servers, cloud infrastructure, or any third-party vendors. SecureNeural has no access to the documents or information you process using the Application.

2. License to Use the Application

2.1. SecureNeural grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application strictly in accordance with these Terms, for your personal or internal business purposes, as applicable based on your purchased license tier.

2.2. You may be required to make a one-time purchase or select a tiered license to access certain features or capacities of the Application. Any such purchase will be subject to the terms of the respective mobile application store (e.g., Apple App Store) and these Terms.

2.3. If license validation is required (e.g., upon initial setup or for premium features), this process will be designed to be minimal and will not involve the transmission of your personal documents or their content.

3. User Data and Privacy

3.1. You, the User, are solely responsible for the documents and data you choose to upload, process, and manage within the Application on your device. You retain all ownership rights to your documents and data.

3.2. As all data processing is local to your device, SecureNeural does not act as a "data processor" or "data controller" under the General Data Protection Regulation (EU) 2016/679 (GDPR) with respect to the content of the documents you process. However, you are responsible for ensuring that your use of the Application to process documents complies with GDPR and any other applicable data protection laws, especially if the documents contain personal data of third parties.

3.3. You are responsible for the security of your own device and for implementing appropriate measures to protect the documents stored and processed within the Application on your device (e.g., device passwords, encryption if available on the device, regular backups of your device). SecureNeural shall not be liable for any loss or corruption of data occurring on your local device.

4. AI Functionality – Acknowledgements and Disclaimers

4.1. The Application utilizes on-device artificial intelligence models to provide features such as document summarization, question answering, and information extraction ("AI Output").

4.2. Accuracy of AI Output: You acknowledge and agree that AI technology, including the models used in SecureNeural, is inherently probabilistic and may produce inaccurate, incomplete, or misleading information. The AI Output is provided for informational purposes only and should not be solely relied upon for making critical decisions.

4.3. User Verification Required: It is your sole responsibility to critically review, verify, and validate all AI Output before relying on it or making any decisions based upon it. You should cross-reference AI Output with the original documents or other reliable sources. Do not assume AI Output is correct, complete, or fit for any specific purpose.

4.4. SecureNeural makes no warranties or representations regarding the accuracy, reliability, completeness, or suitability of the AI Output. Use of the AI features is at your own risk.

5. User Conduct and Responsibilities

5.1. You agree not to use the Service:

  • a. In any way that violates any applicable national or international law or regulation, including but not limited to the laws of Cyprus and the European Union.
  • b. To process any documents for which you do not have the necessary rights, permissions, or consents (e.g., copyrighted material without authorization, confidential information in breach of an obligation, personal data without a lawful basis).
  • c. To reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying AI models of the Application.
  • d. In any manner that could damage, disable, overburden, or impair the Application on your device.

6. Intellectual Property

6.1. The Service and its original content (excluding User-provided documents), features, functionality, and the underlying AI models (as compiled and optimized for on-device use) are and will remain the exclusive property of SecureNeural and its licensors. The Service is protected by copyright, trademark, and other laws of both Cyprus and foreign countries.

6.2. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of SecureNeural.

7. Termination

7.1. We may terminate or suspend your license to use the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

7.2. Upon termination, your right to use the Service will cease. Since all your data is stored on your device, you will retain access to your documents on your device subject to your device's capabilities, but the Application's functionalities related to those documents will cease.

7.3. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Disclaimer of Warranties

8.1. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

8.2. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

8.3. SECURENEURAL, ITS SUBSIDIARIES, AFFILIATES, AND ITS LICENSORS DO NOT WARRANT THAT:

  1. THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE (BEYOND THE ON-DEVICE PROCESSING DESIGN), OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION ON YOUR DEVICE;
  2. ANY ERRORS OR DEFECTS IN THE APPLICATION WILL BE CORRECTED;
  3. THE APPLICATION IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS (USERS ARE ADVISED TO USE THEIR OWN DEVICE SECURITY MEASURES); OR
  4. THE RESULTS OF USING THE SERVICE, INCLUDING ANY AI OUTPUT, WILL MEET YOUR REQUIREMENTS OR BE ACCURATE, RELIABLE, OR COMPLETE.

9. Limitation of Liability

9.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SECURENEURAL, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA (STORED ON YOUR DEVICE), USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  1. YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
  2. ANY CONDUCT OR CONTENT OF ANY THIRD PARTY (OTHER THAN SECURENEURAL) RELATED TO THE SERVICE (E.G., THROUGH THE APP STORE);
  3. ANY CONTENT OR AI OUTPUT OBTAINED FROM OR GENERATED BY THE SERVICE;
  4. UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DOCUMENTS OR DATA STORED ON YOUR DEVICE DUE TO SECURITY BREACHES OF YOUR DEVICE ITSELF;
  5. ANY RELIANCE PLACED BY YOU ON THE COMPLETENESS, ACCURACY, OR EXISTENCE OF ANY AI OUTPUT; OR
  6. ANY DAMAGE TO YOUR MOBILE DEVICE OR LOSS OF DATA THAT RESULTS FROM THE USE OF THE APPLICATION.

9.2. THIS LIMITATION OF LIABILITY APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

9.3. Since the Service operates entirely on-device, SecureNeural is not liable for data loss or corruption occurring on your local device. It is your sole responsibility to implement appropriate backup measures for your device and the data stored on it.

9.4. Our total liability to you for all claims arising out of or relating to these Terms or your use of the Service shall not exceed the amount you paid for the Application, if any.

9.5. Nothing in these Terms shall limit or exclude our liability for death or personal injury resulting from our gross negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Cyprus law.

10. Indemnification

You agree to defend, indemnify, and hold harmless SecureNeural and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms, or c) your documents or data, including any claim that your documents or data infringe the rights of a third party or violate any applicable law.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Cyprus, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the competent courts of Cyprus.

12. Compliance with Local Laws

SecureNeural makes no representation that the Service is appropriate or available for use in jurisdictions outside the European Union. If you use the Service from other jurisdictions, you are responsible for compliance with all applicable local laws.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

14. Changes to Terms of Service

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect, for example, by a notice within the Application or on our website. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

15. Development Status

This application is in active development. Features, functionality, and these terms may change. No guarantees of launch or specific features.
